Late yesterday, a Fulton County
jury awarded a woman
$1.4 million for injuries
sustained when the Five Points station escalator she was riding suddenly reversed, throwing her and other riders to the platform below. The woman was
seriously injured with a broken leg
. The lawsuit alleged that defendants
and the elevator maintenance companies it used for service and maintenance, improperly maintained the Five Points escalator.
The jury took about seven hours to reach their verdict against co-defendants MARTA and Schindler Elevator Corp. Another co-defendant, Elevator Specialists, was found not liable as it had turned over elevator and escalator maintenance in 2007 to Schindler Elevator. The first time MARTA accepted responsibility for the escalator accident was in opening statements to the jury. MARTA is currently "reviewing its options" on whether to appeal the verdict.
